(1) Search report will be sent by email; if trademark certificate require to be forward by courier (extra charge will be involved)
(2) Pre-filing search here is limited to search performed on the Brazil Intellectual Property Office's database only.
(3) Brazil does not recognize multi-class applications.
2.Calculation of Registration Costs
Example 1: One mark one class
If you want to apply to have your trademark "ABC" registered in International Class 7 (machines and machine tools etc), that is, one mark one class, the total fees for both trademark pre-filing search and registration request and certificate are:
Search: USD300 Request for registration: USD1200 Certificate: USD650 TOTAL: USD2150
Example 2: One mark two classes
If you want to apply to have your trademark "ABC" registered in International Class 7 (machines and machine tools etc) and International Class 25 (clothing, footwear, headgear), that is, one mark two classes, the total fees for both trademark pre-filing search and registration request and certificate are:
Search: USD300+USD200=USD500 Request for registration: USD1200+USD1100=USD2300 Certificate: USD650+USD500=USD1150 TOTAL: USD3950
Example 3 : Two marks one class
If you want to apply to have your trademarks "ABC" and "DEF" registered in International Class 7 (machines and machine tools etc), that is, two marks one class, the total fees for both trademark pre-filing searches and registration requests and certificates are:
Search: USD300+USD300=USD600 Request for registration: USD1200+USD1200=USD2400 Certificate: USD650+USD650=USD1300 TOTAL: USD4300
The costs illustrated in the examples above are based on the assumption of a smooth application, that is, no objection being raised by the trademark office or any other third party. Also, the costs stated above exclude courier charges for sending the Power of Attorney and delivery of Certificate of Registration upon acceptance of registration.
3. Materials Required for Filing of Trademark Application in Brazil
Clients need to provide the following materials:
(1) A Power of Attorney executed by the applicant, written bilingually (both Portuguese and the Foreign language); No legalization is required.
(2) A detailed list of products or services to be covered in the application;
(3) Passport/identity card copy or a copy of Certificate of Incorporation or Business Registration Certificate or anything of similar nature which shows the name and address of the applicant;
(4) Declaration Signed by the Applicant. (5) Articles of Association of the Company and its amendments if any.
(6) A priority document when priority is claimed. The document can be filed within 3 months after the filing date of the application.
4. Brazil Trademark Application Procedures
Step by Step Registration Procedures:
Step 1: Clients send to Kaizen (by email or fax or post) a specimen of the trademark, a detailed list of products to be covered by the trademark and at the same time make payment for the pre-filing search to Kaizen by remittance or cheque;
Step 2: Kaizen conduct the pre-filing search and prepare search report and email the search reports to clients;
Step 3: (If the search results indicate that the application is likely to be accepted and clients decide to proceed) Clients send to us the photocopy of identity proof (passport copy for individual and Certificate of Incorporation or Business Registration License) and their articles of association and at the same time make payment for the filing to Kaizen by remittance or cheque;
Step 4: Kaizen prepare the Power of Attorney (PoA) and Declaration and deliver them to clients for execution;
Step 5: Clients send the duly executed PoA and Declaration back to us;
Step 6: Kaizen submit the application documents to the Brazil Intellectual Property Office (INPI);
Step 7: The INPI perform examination and other procedures; if no objection received, the INPI then issues the Certificate of Registration;
Step 8: Kaizen forward the Certificate of Registration to clients.
5. Time Scale
Currently it is taking approximately 36 ?48 months to get a trademark in Brazil. |
