Apply For Food Hygiene and Safety License in Vietnam

Enterprises that operate or produce food must have a food hygiene and safety license. This is a certificate issued by the state authorities to enterprises dealing in or producing food. The main purpose is to prove that the enterprise has fully complied with the necessary conditions for food safety and hygiene. General application for a license requires the employer and personnel to master legal knowledge, conditions, health, etc., as well as many procedures such as installation and operation requirements, kitchen, reception of inspectors.

  1. Which Authority Issues The Food Hygiene and Safety License?

    The authorities that need to issue permits based on the actual food/services of the enterprise are also different, and are currently divided into:
    -Ministry of Health: For food processing and catering companies.
    - Agriculture and rural development: for agricultural, forestry and fishery production and management enterprises.
    - Ministry of Industry and Trade: for enterprises or institutions dealing in food.

    The company has obtained one of the following certificates: Good Practice Manufacturing (GMP), Food Safety Management System ISO 22000, International Food Standard (IFS), Global Food Safety Standard (BRC), Food Safety System Certification (FSSC 22000), Risk Analysis and Critical Control Point (HACCP)



  3. Food Hygiene and Safety Permit Application Process

    Step 1: Register for a food hygiene and safety license, including:
    - Application form
    - Business registration certificate for food
    - The process of storing food in the business area
    - Facility statement form of the enterprise
    - Medical examination report of the employer and personnel
    - Certificate of knowledge of hygiene and stability for employers and personnel participating in food production
    - Source food safety certificate
    - Commitment to ensure food hygiene and safety

    Step 2: 15 days for the handling time.
    Step 3: Get the result: If there is no problem with the inspection business, the business will receive the license.

  4. What Are The Penalties For Not Applying For a Food Hygiene and Safety Permit?

    Currently, administrative penalties are imposed on food safety under Decree No. 115/2018/ND-CP issued by the government on September 4, 2018. Article 18 stipulates that the penalties for not having a food hygiene and safety permit are as follows:
    - Food and beverage services: 20 million to 30 million (VND)
    - Food management and production: 30 million to 40 million (VND)
    - Use of additives other than those specified by the Ministry of Health: 40 million to 60 million (VND)
